For the last 12 years, whenever some seller broke the law by selling contraband on eBay the court room echoed with, “eBay is just a venue.”

As a matter of fact, no matter what responsibility some court or organzation tried to point at eBay, the hallowed halls resounded, “eBay is just a venue.”

Well, just like the business owner who tried to claim his secretary was an independent contractor, it just doesn’t fly anymore.

When eBay starts taking a fifth of your sales, tells you how much you can charge for shipping, restricts the type of payments you can offer, and limits your exposure based on your sales record, it is no longer “just a venue.”  It is now a business partner.

A venue has a set of rules, takes your money and runs your ads.  The rules may govern what you can say, or what type of products they will advertise, but they do not in any form tell you how to run your business.

The minute eBay began to dictate how you run your business, they became co-conspirator to any fraud, liable, or scam perpetrated on their site or in their name. 

In light of the never ending legal battles and losses eBay has been plaqued with in recent years, you would think the powers that be would think of these repercussions.

If you own stock in eBay, my suggestion is to sell while you can still recoup some of your investment.  If any legal minds see this situation as I do, the number of lawsuits against eBay are only going to increase over the next few months.

If you sell exclusively on eBay, you may want to start looking at other options.  They have gained this much control over your business; there is not reason to believe they don’t want more.
